Q4. "What is the legal basis for removing Mr. Blundo, who founded this organization?
Additional related questions: I have known James Blundo in the past and always respected his knowledge and leadership. I am confused about all of this and do not know what to trust. I would like to see the court or legal decision that Dr. Blundo was removed and what legal action was decided upon."

Answer: Mr. Blundo was relieved of his duties as ED by the elected Board at the November 2023 Board meeting. The reason for his dismissal was partly due to the fact that he refused to accept the results of the election and was intentionally sabotaging the transition process to the new board. His actions also included his failure to give the elected Board the monthly financial report, and he instructed the bookkeeper to withhold the financial report from the elected Board as well. As stated earlier, these are significant issues, especially when it comes to a nonprofit organization.

Mr. Blundo’s other acts of insubordination or undermining of the Board include, but are not limited to:
Refusing to give MMHCA property, including access to bank accounts containing $79,000+,
Refusing to give the elected Board of MMHCA access to financial or other records,
Actively undermining the election that was in progress with his October 9, 2023 and October 11, 2023 emails (see previous question).

Blatantly ignoring a Board decision on October 12, 2023 demanding at a public meeting that he not contact members directly, and refusing to give the elected Board of MMHCA access/control of mmhca.org.

Finally, with respect to the assumption that Mr. Blundo “founded” MMHCA. We can find no clear record of who “founded” MMHCA. The names on the first registrations with the State of Michigan do not have Mr. Blundo on them. His name does not appear on LARA records until 2009, 26 years after Mr. Blundo claims to have “founded” it in 1983. It could be true, but we cannot confirm it. From 2004 - 2008 there are other people registered with LARA as running the organization and Mr. Blundo is not mentioned during those years of the earliest state records.

For clarification, an organization does not need a court order or legal decision to stop paying a contracted worker. MMHCA acted within and in accordance to the terms of the contract that Mr. Blundo was keeping from the organization. It is important to also know, Mr. Blundo was never an employee, but was contracted to perform the duties of an executive director, and reported to the Board. He worked at the will of the board. The board has the authority to take action to end that relationship at any time, especially for cause.
